Course Objectives: | As a result of the theoretical and practical studies, students who learn the basic concepts of inheritance law,acquire the ability to resolve the Inheritance law problems. |
The students who have succeeded in this course; I. Defines the related heir. II. Evaluates the conditions of validity of testamentary dispositions. III. Distinguish types of testamentary disposition. IV. Defines the statutory entitlement. V. Identifies and seeks solutions to problems related to statutory entitlement. VI. Identifies the acquisition moment of Heritage and analyzes the necessary procedure. VII. Defines and sets out the terms of the right to renounce. VIII. Evaluate the stages of community of heirs and division of the Estate. |
Week 1: Subject and nature of the Inheritance Law Week 2: The main concepts of inheritance law, related heirship Week 3: Testemantary capacity; formal requirements of testamentary dispositions; revocation and destruction of the testamentary dispositions. Week 4: Naming of heirs and legacy; burdens and conditions Week 5: Subtititions; remaindermen; executors Week 6: Contracts of succession Week 7: Renunciation of inheritance Week 8: Limits of testamentary freedom; disposable part; statutory entitlement Week 9: Mid-term Exam Week 10: Disinheritance and hotchpot duty of the heirs Week 11: Action in abatement in case of the exceed of the testamentary freedom Week 12: Legal capacity; measures to safeguard succession; release and vesting of the estate Week 13:Right to renounce; public inventory and accenptence subject to public inventory; action for recovery of inheritance 14.
