Course Objectives: This course aims to support theoretical knowledge with practice and practice, thus preparing students for the legal profession. Students will use the theoretical knowledge they have learned about the criminal procedure process in the solutions of fictional cases they will encounter.

Learning Outcomes

The students who have succeeded in this course;
At the end of this course, students will:
1. Will learn the importance of the principles that dominate the prosecution phase in criminal procedure processes,
2. Will have information about the preparation process for the hearings,
3. Learn the procedure for holding the hearings and the role of the lawyer in the hearing,
4. Will have information about the types of provisions and legal remedies,
5. They will practice the role of the lawyer in the hearing and the writing of the petition at the prosecution stage within the scope of the fictional case study.

Course Content

The Constitution, the European Convention on Human Rights, the laws and regulations regarding the criminal justice system, the Supreme Court decisions, the ECHR decisions, the defense petition samples, the investigation-prosecution file to be studied.
Lectures, real investigation-prosecution files, examination-research, hearing monitoring, evaluation-discussion, written-oral presentation studies.

2) Commencement of the Prosecution Phase - Acceptance of the Indictment - Principles of Prosecution (Vocabulary, openness, commitment, continuity, reciprocity etc.) and Exceptions - Trial Preparation - Beginning of the Trial - The Walk of the Trial
3) Questioning of the Defendant - Obligation of the Defendant to be Present at the Trial and Exceptions - SEGBIS - Preparation of the Defendant for Interrogation - Query - Asking Direct Questions
4) Evaluation of Evidence by Listening to Witness and Complainant - Hearing of Witness and Complainant - Preparation of the Witness - Evidence (Statement, Symptom, Document) - Discussion and Appreciation of Evidence (Unlawful Evidence, etc.)
5) Substantive Defense/Statement, Additional Defense and Provision - Fundamental Defense - Statement on the Substantive - Additional Defense - Additional Indictment - Minutes of the Hearing - Termination of the Hearing and Judgment (Types of Provisions, HAGB, Postponement, etc.)
