Course Objectives: | In this course, basic concepts of competition law; functioning of the competition authorities, examination of specific institutions in this context will be discussed to solve the legal problems arising in practice. |
The students who have succeeded in this course; I. Students will be able to define the basic concepts of competition law. II. By recognizing the competition law institutions, the students will be able to solve the problems in practice. III.students will be able to distinguish the specific problems arising in the application of competition law. IV. At the end of the course students will have the ability to use competition law mechanisms. |
Introduction to Competition Law, Basic Concepts Development of the Turkish Competition Law, the scope of the Law on Protection of Competition, Field of Application, Theory of Influence Violation of competition through agreements between undertakings, decisions by associations of Undertakings and concerted practices The presumption of concerted action in the oligopolistic market Negative clearance and exemption, individual exemption and block exemption Applications of exemption and De Minimis Rule, various examples of exemptions Concept and the determination of Dominant Position, Cases of Abuse of Dominant Position Obligation to contract resulting in Competition Law Control of Concentration in Competition Law, Application Criteria Control of Mergers and Acquisitions, Privatization Violations of competition, Legal Effects of the decisions of Competition Authority in private law. |
