Course Objectives: The scope of the international family law course concerns family law problems having foreign elements. In this context, the conflict of law rules settled by Turkish Private International Law Act (No: 5718) and bilateral or multilateral international agreements regarding family law relations that Turkey has adopted will be focused on. Additionaly, the party autonomy principle increasingly accepted in international family law and the conclusions of this acceptance wil be discussed. Finally, the jurisdiction of Turkish courts and basic principles governing the recognition and enforcement of foreign decisions regarding international family disputes will be analysed.

Learning Outputs

The students who have succeeded in this course;
I. Determines the international family law issues.
II. Recognizes the conflict of law rules in international family law.
III. Analyzes bilateral or multilateral international agreements regarding family law relations.
IV. Recognizes the general principles regarding the party autonomy principle in international family law.
V. Recognizes the general princiles regarding the jurisdiction of Turkish court and the recognition and enforcement of foreign decisions in Turkey regarding international family law disputes.
