Course Objectives: To make discussions on the provisions of new Turkish Obligation Code numbered 6098 in the light of current developments, to render the participants having a comprehensive view point and to urge them to make a research and carry out a debate upon their research topics.

Learning Outputs

The students who have succeeded in this course;
I. Distinguishes the labour contracts from other similar contracts related to the servicing
II. Defines the obligations and rights of employees arising from labour contract according to Turkish Obligation Code
III. Defines the obligations and rights of employers arising from labour contract according to Turkish Obligation Code
IV. Analyzes the obligations of employees after the termination of labour contract
V. Evaluates the legal consequences of the termination of labour contract both for employee and employer.
VI. Analyzes the legal regulations on working times, leisure and resting times for the duration of employment relationship
VII. Determines the claims of employees and evaluates how to calculate compensations and amount of claims
VIII. Assesses the connection between Turkish Obligation Code numbered 6098 and Turkish Labour Code numbered 4857

1.Week: According to Turkish Obligation Code numbered 6098 the definition and the constituents of labour contract
2.Week: Different features of labour contract: the definition and the constituents of employment contracts for salesman and employment contracts for domestic workers
3.Week: Obligations of employees: working in person, obligation of care and loyalty
4.Week: Obligations of employees: working in obedience, overtime working and the limitations of workers' responsibilities.
5.Week: Obligations of employers: essence of wage payment, models of wage payment and wage assurances
6.Week: Obligations of employers: the protection of workers' personality and personal data
7.Week: Extinction by contract and contractual penalties
8.Week: Leisure and resting times
9.Week: Alteration of the relationship between employee and employer: transfer of contract and transfer of workplace
10.Week: The termination of fixed-term contracts and its legal consequences
11.Week: The termination of indefinite-term contracts: The notice of termination and the protection to employees from the termination of contract
12.Week: The termination of indefinite-term contracts: Termination by just cause and its legal consequences
13.Week: The termination of contract on prohibition of competition
14.Week: The termination of employment contracts for salesman and employment contracts for domestic workers
15.Week: Final Exam
