| Dersin Amacı: | Bu ders öğrencilere, en önemli Topluluk politikalarından biri olan AB rekabet politikasının temellerini tanıtır. Bu sadece Adalet Divanı nezdinde davaların çok büyük bir oranına sahip olmasından dolayı önemli değil, aynı zamanda ekonomik, finansal ve entelektüel çıkarları içerdiği için de önemlidir. Ders, politikanın teorik arka planının yanı sıra yasal dayanaklarından oluşacaktır. İlk olarak, mükemmel rekabet ve uygulanabilir rekabet gibi kavramlar, rekabet politikasına neden ihtiyaç duyulduğunun açıklaması ile birlikte tanıtılacaktır. Ardından, rekabetin düzenlenmesine ilişkin AB Antlaşmasının 101. ve 102. Maddeleri derinlemesine incelenecektir. Devlet yardımları olan bu dersin önemli bir kısmını teşkil etmektedir. |

Bu dersi başarıyla tamamlayabilen öğrenciler; Bu dersi başarıyla tamamlayabilen öğrenciler; 1. Serbest piyasa ekonomisinin dinamiklerini ve bunların AB'nin rekabet politikası ile ilişkilerini açıklar; 2. AB rekabet politikasının temel içtihat hukukunu, ilgili Antlaşma Maddeleri çerçevesinde analiz eder; 3. AB'nin rekabet politikasına ilişkin içtihat maddelerini vaka analizleri çerçevesinde ve AB'nin ekonomik bütünleşme sürecinde değerlendirir; 4. Normatif rekabet teorisini, fikri mülkiyet hakları gibi AB'nin diğer ilgili politikalarıyla karşılaştırmalı olarak tanımlar; 5. Bu politikanın AB içindeki ve AB dışındaki dış ticaret boyutunu değerlendirir; 6. AB bünyesindeki devlet yardımı prosedürlerinin işleyişini açıklar. |
