Course Objectives: | Basic purpose of the course is to help students to think about human rights and related issues in historical, comparative and international perspective with a view to enable them to understand the concept of human rights, its problems and solutions. |
The students who have succeeded in this course; I. Define the historical evolution of human rights including some philosophical and jurisprudential background. II. Overview how human rights have been perceived in different national and cultural contexts. III. Discuss and critically evaluate the fundamental concepts, principles underlying international human rights law. IV. Concisely review and discuss various roles and activities of international human rights system created either by United Nations and European Council. V. Overview the main features and impacts of these international instruments on the promotion and protection of human rights. VI. Specially recognize and actively discuss the implementation of “the Convention for the Protection of Human Rights and Fundamental Freedoms” as a regional human rights instrument. |
In the first part of this course we will briefly discuss the historical evolution of human rights including some philosophical and jurisprudential background of the evolution. We will also overview how human rights have been perceived in different national and cultural contexts. The second part we will concisely review and discuss various roles and activities of international human rights system which was established under the auspice of the United Nations. Namely; International Covenant on Civil and Political Rights; International Covenant on Economic, Social and Cultural Rights; Convention on the Elimination of All Forms of Racial Discrimination and the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. Individual complaints on human rights violations. For that reason, we will dedicate most of our times to the case law of that Court, namely European Court of Human Rights. Students are free to choose any relevant book concerning human rights. Lecture notes will be prepared and made available from the website of “ois.” |
